EL GBR Y RIESGOS GEOLÓGICOS EN CONTRATOS FIDIC

He publicado un nuevo artículo junto a Emilio Linde-Arias en la prestigiosa Revista de Obras Públicas, centrado en los riesgos geológicos y el uso del Geotechnical Baseline Report (GBR). Analizamos su importancia fundamental en el contrato FIDIC Emerald Book (túneles) y ofrecemos recomendaciones prácticas.

Esto abre un debate interesante: ¿Se utiliza el GBR adecuadamente en el sector? ¿Es preferible tener un mal GBR a no tener ninguno? Creemos que la clave es la colaboración entre abogados, ingenieros y arquitectos para producir documentos contractuales que realmente eviten conflictos.

Curiosamente, NEC acaba de publicar su propia guía para obras subterráneas. Esto demuestra cómo los grandes contratos modelo (FIDIC y NEC) se retroalimentan, permitiéndonos comparar enfoques y extraer las mejores soluciones para hacer nuestro trabajo más eficaz.

I am attending FIDIC ASIA PACIFIC MID-YEAR CONFERENCE 2025, in Islamabad, Pakistan, as a Speaker. Participation of Development Banks is confirmed. Join us to share insights about FIDIC contracts and how their use can improve infrastructure projects in the region. I had the privilege to work for UNOPS two whole years in Kabul, Afghanistan, and my "administrative duty station" was Islamabad.

I am happy to go back to the area and contribute with my fellow speakers to spread the benefits of using FIDIC contracts "the right way" and help to make development efforts in the wider region more effective so the population of Pakistan and neighbouring countries can live their lives in a better environment. Perhaps the conference will take place a little later than initially planned, but it will happen, and we will be there.
